For any democratic election to take place, there is a need for candidates to contest elections. The Contestants are referred to as candidates. Candidate nomination is therefore a formal process of endorsing a candidate\u2019s participation in an election. Due process has to be followed. The Returning Officer should draw up a timetable for lodging of nominations.<\/p>\n
Section 33 of the Electoral Act No. 12 of 2006 stipulates that any person desiring to be a candidate for an election shall file such application with the Returning Officer. For Any Interested Person, the qualification for the different categories are as follows:<\/p>\n
(a)\u00a0\u00a0\u00a0 Presidential<\/strong><\/p>\n Qualifications<\/strong><\/p>\n A person qualifies to be nominated as a candidate for election as a President if that person;<\/p>\n i.\u00a0\u00a0\u00a0\u00a0\u00a0 is a citizen by birth or descent;<\/p>\n ii.\u00a0\u00a0\u00a0\u00a0 has been ordinarily resident in Zambia;<\/p>\n iii.\u00a0\u00a0\u00a0 is at least thirty-five years old;<\/p>\n iv.\u00a0\u00a0\u00a0 is a registered voter;<\/p>\n v.\u00a0\u00a0\u00a0\u00a0 has obtained, as a minimum academic qualification, a grade twelve certificate or its equivalent;<\/p>\n vi.\u00a0\u00a0\u00a0 is fluent in the official language;<\/p>\n vii. \u00a0has paid\u00a0 taxes or has made arrangements, satisfactory to the appropriate tax authority, for the payment of the taxes;<\/p>\n viii. declares\u00a0 assets and liabilities,<\/p>\n ix.\u00a0\u00a0\u00a0 pays the prescribed election fee on, or before, the date fixed for the delivery of nomination papers; and<\/p>\n x.\u00a0\u00a0\u00a0\u00a0 is supported by at least one hundred registered voters from each Province.<\/p>\n A person is disqualified from being nominated as a candidate for election as President if that person;<\/p>\n i.\u00a0\u00a0\u00a0\u00a0\u00a0 is a public officer;<\/p>\n ii.\u00a0\u00a0\u00a0\u00a0 has dual citizenship;<\/p>\n iii.\u00a0\u00a0\u00a0 is holding or acting in a Constitutional office or other public office;<\/p>\n iv.\u00a0\u00a0\u00a0 is a judge or judicial officer;<\/p>\n v.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 was removed from public office on grounds of gross misconduct in the immediate preceding five years;<\/p>\n vi.\u00a0\u00a0\u00a0\u00a0\u00a0 has a mental or physical disability that would make the person incapable of performing<\/p>\n the executive functions;<\/p>\n vii.\u00a0\u00a0\u00a0\u00a0 is an undischarged bankrupt;<\/p>\n viii.\u00a0\u00a0\u00a0 is serving a sentence of imprisonment; or<\/p>\n ix.\u00a0\u00a0\u00a0\u00a0 has, in the immediate preceding five years, served a term of imprisonment of at least three\u00a0 years.<\/p>\n Requirements<\/strong><\/p>\n The aspiring candidate should have the following;<\/p>\n i.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Duly completed Affidavit Form;<\/p>\n ii.\u00a0\u00a0\u00a0\u00a0\u00a0 Letter or certificate of adoption if sponsored by a political party;<\/p>\n iii.\u00a0\u00a0\u00a0\u00a0 Duly completed nomination form;<\/p>\n iv.\u00a0\u00a0\u00a0\u00a0 Aspiring candidate\u2019s photograph measuring 32 x 25 mm on a prescribed background;<\/p>\n v.\u00a0\u00a0\u00a0\u00a0\u00a0 Duly completed Declaration of Compliance to the Electoral Code of Conduct (Form ECCI).<\/p>\n (b)\u00a0 Mayoral and Council Chairpersons Elections<\/strong><\/p>\n Qualifications<\/strong><\/p>\n A person qualifies to be nominated as a candidate for election as a Mayor\/Council Chairperson if that person;<\/p>\n i.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 is a citizen;<\/p>\n ii.\u00a0\u00a0\u00a0\u00a0\u00a0 is at least twenty-one years old;<\/p>\n iii.\u00a0\u00a0\u00a0\u00a0 is a registered voter;<\/p>\n iv.\u00a0\u00a0\u00a0\u00a0 has obtained, as a minimum academic qualification, a grade twelve certificate or its equivalent;<\/p>\n v.\u00a0\u00a0\u00a0\u00a0\u00a0 declares\u00a0 assets and liabilities;<\/p>\n Requirements<\/strong><\/p>\n i.\u00a0\u00a0\u00a0\u00a0\u00a0 Duly completed Affidavit Form;<\/p>\n ii.\u00a0\u00a0\u00a0\u00a0\u00a0 Letter or Certificate of Adoption if sponsored by a political party;<\/p>\n iii.\u00a0\u00a0\u00a0\u00a0\u00a0 Duly completed Declaration of Compliance to the Electoral Code of Conduct (ECC1);<\/p>\n iv.\u00a0\u00a0\u00a0\u00a0\u00a0 Pay a non-refundable nomination fee on, or before, the date fixed by the Commission;<\/p>\n v.\u00a0\u00a0\u00a0\u00a0\u00a0 Duly completed Nomination Form;<\/p>\n vi.\u00a0\u00a0\u00a0\u00a0\u00a0 Aspiring candidate\u2019s photograph measuring 32 x 25 mm on a prescribed background;<\/p>\n vii.\u00a0\u00a0\u00a0\u00a0\u00a0 Fifteen supporters who are registered voters within that particular Council.<\/p>\n (c) National Assembly<\/strong><\/p>\n Qualifications<\/strong><\/p>\n A person qualifies to be nominated as a candidate for election as a Member of Parliament if\u00a0 \u00a0that person;<\/p>\n i.\u00a0 \u00a0is a citizen;<\/p>\n ii.\u00a0 \u00a0is at least twenty one years old;<\/p>\n iii.\u00a0 \u00a0is a registered voter<\/p>\n iv.\u00a0 \u00a0has obtained, as a minimum academic qualification, a grade twelve certificate or its equivalent;<\/p>\n v.\u00a0 \u00a0declares that person\u2019s assets and liabilities, as prescribed; and<\/p>\n vi.\u00a0 \u00a0fifteen supporters\u00a0 who are registered voters within that particular constituency.<\/p>\n Requirements<\/strong><\/p>\n i.\u00a0 \u00a0duly completed\u00a0 affidavit form;<\/p>\n ii.\u00a0 \u00a0letter or certificate of adoption if sponsored by a political party;<\/p>\n iii.\u00a0 \u00a0duly completed declaration of compliance to the electoral code of conduct (ecc 1);<\/p>\n iv.\u00a0 \u00a0pay a non-refundable nomination fee on, or before, the date fixed by the commission v.\u00a0 \u00a0duly completed nomination form;<\/p>\n vi.\u00a0 \u00a0aspiring\u00a0 candidate\u2019s\u00a0 photograph measuring 32mm x 25mm on a prescribed background.<\/p>\n (d) Councillor<\/strong><\/p>\n Qualifications<\/strong><\/p>\n A person qualifies to be nominated as a candidate for election as a Councillor if that person;<\/p>\n i.\u00a0 \u00a0is nineteen years of age;<\/p>\n ii.\u00a0 \u00a0has obtained, as a minimum academic qualification, a grade twelve certificate or its equivalent;<\/p>\n iii.\u00a0 \u00a0is a citizen or a holder of a resident permit, resident in the district;
