XII : CHIEFS AND HOUSE OF CHIEFS

127.
(1) Subject to the provisions of this
Constitution, the Institution of Chief
shall exist in any area of Zambia in
accordance with the culture, customs
and traditions or wishes and
aspirations of the people to whom it
applies.
(2) In any community, where the issue
of a Chief has not been resolved, the
issue shall be resolved by the
community concerned using a method
prescribed by an Act of Parliament.

128.
The following concepts and principles
shall apply to Chiefs
(a) the Institution of Chief shall be
a corporation sole with perpetual
succession and with capacity to sue
and be Chiefs
sued and to hold assets or properties
in trust for itself and
the people concerned;
(b) nothing in paragraph (a) shall be
taken to prohibit a Chief from holding
any asset or property acquired in a
personal capacity; and
(c) a traditional leader or culture
shall enjoy such privileges and
benefits as may be conferred by the
Government and the local Government or
as the leader may be entitled to under
cu1ture, custom and tradition.

A person shall not, while remaining a
Chief, join or participate in partisan
politics. |

130.
There shall be a House of Chief for
the Republic which shall be an
advisory body to the Government on
traditional, customary and any other
matters referred to it by the
President.

131.
Notwithstanding Article 130, the House
of Chiefs may-
(a) consider and discuss any Bill
dealing with, or touching on,
customary or tradition before it is
introduced into the National Assembly;
(b) initiate, discuss and decide on
matters that relate to customary law
and practice;
( c ) consider and discuss any other
matter referred to it for its
consideration by the President or
approved by the President for
consideration by the House; and
( d) submit resolutions on any Bill or
other matter referred to it to the
President, and the President shall
cause such resolutions to re laid
before the National Assembly.

132.
(1) The House of Chiefs shall consist
of twenty-seven Chiefs.
(2) The members referred to in clause
(1) shall consist of three chiefs
elected by Chiefs from each of the
nine Provinces of the Republic.
(3) The Chairman and the Vice-Chairman
shall be elected from amongst the
members.

133.
(1) A member of the House of Chiefs-
(a) shall hold office for a period of
three years and may be re-elected for
a further period of three years; or
(b) may resign upon giving one month's
notice in writing to the Chairman.
(2) The office of member shall become
vacant-
(a) upon his death;
(b) if he ceases to be a Chief;
(c) if any other circumstances arise
that would cause him to be
disqualified for election;
(d) if he becomes a candidate to any
election, or accepts an appointment,
to any office in a political party;
(e) if he is adjudged or becomes an
undischarged bankrupt; or
(f) if he is declared or becomes of
unsound mind under any law in Zambia.

134.

135.
There shall be a Clerk of the House of
Chiefs and such other staff as may be
necessary for carrying out the
functions under this Part

136.
Subject to the provisions of this
Constitution, the President
may by statutory instrument make
regulations for-
( a) the appointment of the Clerk and
other officers of the House of Chiefs;
( c ) the proceedings and conduct of
the House of Chiefs:
( d) the application of any of the
privileges and immunities of
the National Assembly and its members
to the House of Chiefs and its
members: and
(e) such other matters as are
necessary or conducive to the better
carrying out of the purposes of this
Part.
